PARMALAT AUSTRALIA LTD “VAALIA 2 WEEK TRIAL” OFFER
HOW TO PARTICIPATE

1. To complete the Vaalia 2 Week Trial, individuals must purchase 14 serves of Vaalia yoghurt (each serve being between 90g to 175g, with a total of at least 1,260g) within a two week period during the offer period from a participating retailer that issues itemised receipts stating the products as “Vaalia” brand and the price for each item, and consume a serve of Vaalia yoghurt each day over 14 consecutive days.

2. To claim, if the claimant is not completely satisfied with Vaalia yoghurt at the end of Vaalia 2 Week Trial, claimants must then:

(a) obtain the official claim form for download at www.vaalia.com.au

(b) fully complete their details on the form;

(c) answer the question “Why didn’t you see the benefits of Vaalia yoghurt
during the two week trial?” in 25 words or less;

(d) attach your original product purchase receipt(s) which clearly show the
Vaalia products purchased, the price paid for each item and the date of purchase; and

(e) send the completed claim with the purchase receipt(s) together to:
‘Vaalia 2 Week Trial’, PO Box 602, Eastern Suburbs Mail Centre, NSW 2004
so that the claim is received by last mail on 31/7/08.

TERMS AND CONDITIONS

1. Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. This offer is not valid in conjunction with any other offer.

2. Claims are only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this offer are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete, indecipherable or illegible claims will be deemed invalid.

5. Only one claim permitted per household.

6. Claimants must retain their original purchase receipt(s) for all claims as proof of purchase. Purchase receipt(s) must clearly specify the store of purchase, the Vaalia product purchased (including the brand “Vaalia”) and that the purchase was made during the offer period. The purchase receipts must show that the claimant has purchased sufficient quantities of Vaalia yoghurt to consume a serve every day for fourteen (14) consecutive days before the date that their claim is submitted. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an claimant’s claims and forfeiture of any right to an offer.

7. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

8. Offer commences 5/5/08. Consumers must start their trial no later than 16/7/08 to have sufficient time to complete the trial over 14 days and send in their claim. Claims close last mail received on 31/7/08.

9. Successful claimants will be notified by mail within 28 days.

10.The Promoter’s decision is final and no correspondence will be entered into.

11. Every valid claim received will be awarded cash back for the purchase price of the Vaalia products purchased to qualify up to a maximum value of $15.

12. Cash back will be awarded in the form of a cheque made payable to the claimant. Offer is not transferable or exchangeable.

13. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.

14. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.

15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (f) use of the offer.

16. The Promoter collects personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including but not limited to suppliers and, as required, to Australian regulatory authorities. Claiming is conditional on providing this information. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
